A ‘thoughtless’ teenager spotted swerving on the road in the early hours of the morning was over the legal drink-drive limit. Plasterer Zaiden Moyniham was also in found to be in possession of cannabis when his car came to a halt at Broadgate, Whaplode Drove . “It was around 2.
15am on March 22 when police saw an Audi A3 swerving left and right and almost crashing into parked cars,” prosecutor Turan Sunat told Boston Magistrates’ Court. “The driver pulled on to a driveway. He had glazed eyes and was swerving in his seat.
“In what appeared to be a tobacco packet, police also found herbal cannabis.” Nineteen-year-old Moynihan gave a reading of 52 micrograms of alcohol per 100ml of breath. The legal limit is 35mcg.
In defence, Beris Brickles said his client would lose his job as a result of being banned from the roads. “He made a very poor mistake and his job will lead to a loss of livelihood,” he said. “He was enjoying a weekend with friends in Skegness when he received an emotional call from his girlfriend.
“She was crying down the phone and he made the poor decision, having had alcohol, to drive home.” Mr Brickles added his client’s erratic driving was not due to alcohol consumption but because he was ‘fumbling’ around looking for a cigarette lighter. Moynihan, of Kipling Crescent, Stotfold, Bedfordshire, pleaded guilty to drink driving and possessing the Class B drug when he appeared in court on Wednesday (April 9).
In a letter to the court, he said he felt ‘deep remorse’ and described his behaviour as ‘thoughtless and selfish’. Moynihan was disqualified from driving for 14 months, which could be reduced by 14 weeks if he completes the drink driver rehabilitation course. He was also fined a total of £200 and ordered to pay £85 costs and an £80 victim surcharge.
Magistrates also ordered the forfeiture and destruction of the cannabis..
