Swargate bus rape case in Pune: Prosecution to challenge magisterial court orders to seek custody of accused

Pune: The office of assistant director of public prosecution has given city police crime branch approval to file a criminal revision petition challenging the orders passed by a magisterial court in connection with the rape of a 26-year-old health counsellor in a Shivshahi bus parked on the premises of MSRTC's Swargate terminus on Feb 25. Additional public prosecutor Vijay Fargade said a proposal to file the petition, drafted by assistant prosecutor Bhagyashree Sancheti handling the case before the magisterial court, received sanction under section 440 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The proposal was prepared after examining the correctness, legality or propriety of the two orders passed by the magistrate on April 1 and 2, Fargade said.

"We completed the legal formalities, and a petition would be filed online on the district court website on Monday. It will be listed for hearing before an additional sessions judge on the same day," he said, adding the prosecution would pray to expedite the hearing in the public interest. The investigating officer, Shailesh Sankhe from crime branch, earlier submitted a letter to the prosecution requesting it to challenge the magistrate's order of April 1.



The order rejected police's plea to issue a production warrant for the custody of accused Dattatray Gade (37). Sankhe also wanted the court order of April 2, which rejected police's plea to send Gade into remand for a day under section 187 (2) of BNSS, challenged. Gade's bail plea has been listed for hearing before the sessions court on April 8.
