Supreme Court Raps UP Police, Says 'Cops Enjoying Power, Needs To Be Sensitised'

The Supreme Court bench was hearing Dubey's appeal against an August 13 order of the Allahabad High Court refusing to quash an extortion case against him.

New Delhi: The Supreme Court objected to Uttar Pradesh converting civil cases into criminal, saying that the cops are "enjoying power" and "needs to be sensitized." The court warned that it would not hesitate to pass adverse orders against the state police. A bench of justices Surya Kant and Ujjal Bhuyan heard the matter which said that multiple criminal cases were filed against gangster Anurag Dubey even in cases in which the allegations were civil in nature.

The bench noted that the petitioner was seemingly under the fear that if he appears for an investigation, a new case would be registered against him by the Uttar Pradesh Police. "He must not be appearing because he knows that you will register another false case and arrest him there. You can convey your DGP the moment he (Dubey) is touched, we will pass such a drastic order he will remember his whole life.



Every time you come with a new FIR against him! How many cases prosecution can uphold?" the bench said, as quoted by Live Law. "It's very easy to allege land-grabbing. Someone who purchased by a registered sale deed, you say land grabber! Is it a civil dispute or criminal dispute? We are only pointing out what dangerous area your police is entering and they are enjoying it! Who would like to miss the power? Now you are assuming the power of the police, now you are assuming the power of the civil court! And therefore you are enjoying," the bench added.

The Bench was hearing Dubey's appeal against an August 13 order of the Allahabad High Court refusing to quash an extortion case against him. The Supreme Court had in October upheld this aspect of the High Court order, but issued notice on the issue of grant of anticipatory bail. It had also granted Dubey interim protection from arrest in the matter.
