Rolling Stones vs. The American Stones

On Nov. 25, 2024, Musidor BV., the registered owner and manager of the trademarks and copyrights of the “ROLLING STONES” band, filed with the Trademark Trial and Appeal Board of the United States Patent and Trademark Office an Opposition to the trademark application for “THE AMERICAN STONES.

” In the Opposition, Musidor states that it is the owner of the “ROLLING STONES” trademarks used for musical sound recordings, audiovisual recordings, entertainment in the nature of a live musical performer, badges and novelty pins, clothing, paper products, alcoholic beverages and restaurant services. The Opposition adds that the “ROLLING STONES” is an English rock band formed in London in 1962 and it has been active for six decades. The applicant for “THE AMERICAN STONES” trademark is a band that plays the songs of the “ROLLING STONES.



” The Opposition also avers that the “ROLLING STONES” is commonly referred to as “THE STONES” and the word “STONES” is the dominant feature of the “ROLLING STONES” trademarks. It is alleged that the use of “THE AMERICAN STONES” would result in confusion, mistake and/or deception and would mislead people into thinking that “THE AMERICAN STONES” is associated with the “ROLLING STONES.” (https://ttabvue.
