Eyna restaurant, in East Mayne, Basildon, proved a hit with residents when it opened at the start of the year but its future was thrown into doubt when the Home Office and Essex Police raided the business in July. Yesterday, after the Government department claimed “illegal working has been identified” at the premises. However, councillors decided against revoking the restaurant’s licence after hearing “appropriate measures”, including a new training system and additional checks had been put in place.

Abdullah Tekagac, owner of the restaurant, also told the meeting he had “taken back control” of the premises on September 24 and a previous tenant removed from the business. He said: “I am very satisfied with the outcome, I am pleased that the licensing committee listened to my representations and were satisfied that going forward we will be promoting licensing objectives. “The committee acknowledged that there were no other matters of concern other than checking the right to work.

“New measures have been put in place to address that concern.” Despite the decision to allow the restaurant to continue trading, Mr Tekagac was warned that any further issues would result in a fresh hearing where the council will consider revoking the licence. All current staff at the restaurant have gone through the required employment checks, the meeting was told.

Speaking on behalf of the committee, Ms Robbins said: “In reaching the decision, the subcommittee has taken into account the relevant parts of the written and oral evidence before them, the relevant parts of the council’s statement of licensing policy, the relevant parts of the guidance issued by the Secretary of State. “Having considered the application for review of a premises licence, to take no further action. “It reminds the premises licence holder that should there be any further instances, that this matter could be brought back to the licensing subcommittee where revocation of the premises licence will be considered.
