Pune: The state prosecution filed a criminal revision petition before a sessions court on Monday against the lower court's orders of April 1 and 2 rejecting the police's plea seeking Swargate bus rape accused Dattatray Gade 's custody from Yerawada jail against a production warrant and remanding him in police custody. The petition will be listed for hearing before a sessions judge on Tuesday. Gade was arrested in connection with the rape of a 26-year-old health counsellor in a Shivshai bus parked on the premises of Swargate bus terminus on Feb 25.
Additional public prosecutor Vijay Fargade said, "The custodial interrogation of Gade is essential because the police need to confront him with technical/digital evidence like CCTV footage, call detail record, tower location, and subscriber data record, among other evidence relating to statements of witnesses for the purpose of conducting further investigations and filing a chargesheet." Fargade explained that as per the provisions of section 187 (2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), the investigating officer is authorised to seek custodial interrogation of Gade within the first 60 days from Feb 28 when the accused was produced before the lower court. Gade is involved in a case of repeated sexual assault, and the time limit for filing a chargesheet under the provisions of section 193 of BNSS is 90 days for cases triable by a sessions court, he added.
