Sean 'P. Diddy' Combs' lawyers are drudging up case law in an effort to get their client out from behind bars . As Diddy awaits trial, his legal team is making repetitive requests to get the disgraced music mogul out on bail.

However, the judge continues to shut down the ask as prosecutors flag concern over his influence, flight risk, and alleged communications with witnesses. Now, Diddy's team is looking to a past case involving President-elect Donald Trump . In court documents obtained by The Mirror, Diddy's team points to United States v.

Trump , a case which dealt with the President-elect's alleged involvement in the January 6 Capitol insurrection and his alleged efforts to overturn the 2020 U.S. presidential election.

The case itself was a criminal proceeding, but also set potential precedent on the matter of how gag orders are kept in place and a defendant's potential right to contact witnesses while working with their attorneys. Diddy accused of 'witness tampering and violent conduct' as prosecutors ask judge to deny bail Sean 'Diddy' Combs' bail request to be determined next week as he awaits trial Prosecutors previously flagged concern with Diddy's communications with the outside world, particularly alleging he was contacting witnesses. Furthermore, they claimed he was participating in a strategic media campaign to bias potential jury members through his social media.

The defense claimed that, if Diddy contacted witnesses, it would be a constitutionally protected action given the previously upheld standards of Trump's case. They argued that, like the courts ruled for Trump, Diddy has “a greater constitutional claim than other trial participants..

. to speak out against the prosecution and the criminal trial process that seek to take away his liberty," adding, "Accordingly, the Court should apply Trump's heightened standard when considering Mr. Combs.

” However, they conceded that Diddy was willing to stop contacting witness if he was offered bail, noting: "If released Mr. Combs will accept any condition that instructs him to 'avoid all contact with an alleged victim ..

. and with a potential witness.'" This would be a precedent established by the Trump case which noted: "Mr.

Trump ...

accept[s] his pretrial release condition that he cannot speak to witnesses in the case about political matters or otherwise.” Diddy's team, though, doubled down on their argument that he had a right to speak with witnesses, writing: "While detained, however, and in the absence of such a condition, the status quo remains that Mr. Combs has a constitutional right to assist his lawyers in reaching out to witnesses.

" Previously, Diddy was denied bail when he asked to be held on a private island. He also offered a plan to be held in a guarded New York City apartment. The judge blatantly told him that wouldn't work.
