It appears that, at this point, there won't be a settlement in the adverse action appeal filed by former airport police officer Pan Sa Kim. Attorney William Brennan, counsel for the A.B.
Won Pat International Airport Authority, stated Wednesday during a status call of the Civil Service Commission that, at this time, airport management is not amenable to the terms offered for the settlement. Attorney Edwin Torres, representing Kim, agreed that negotiations are unlikely. The CSC asked the parties to complete a case management statement, and set another status call for Dec.
4. "What we'll do on (Dec. 4) is set up the date for a witness list, exhibit list, any motion deadlines, as well as motion hearings and a hearing on the merits," CSC Administrative Law Judge Katherine Nepton stated during the status call on Wednesday.
Kim was accused of inappropriately touching a woman he assisted in early January 2020. He allegedly followed the woman into a bedroom to retrieve a phone charger before allegedly stroking the woman's hair and touching her breast. He was arrested and charged with fourth-degree criminal sexual conduct and official misconduct, both as misdemeanors.
Kim initially pleaded not guilty to the charges, but entered a change of plea in 2023, pleading guilty to official misconduct. The charge of fourth-degree criminal sexual conduct was dismissed. Kim was sentenced to one year in prison, but that was suspended, and he was given credit for time served.
Kim also was placed on two years of supervised probation. As a condition of release, Kim cannot seek employment with the government of Guam or any of its agencies, including the Guam Police Department, at any time in the future. In addition to the arrest, Kim was terminated from his job at the airport in April 2020 following an administrative investigation into allegations against him.
He challenged his termination at the CSC, where the case continues even as the criminal matter has been settled..
