N.J. medical transport company underpaid dozens of workers, officials say

The company is accused of misclassifying drivers to transport patients between non-emergency facilities, authorities said.

A Camden County company has been accused of misclassifying at least 52 employees and failing to pay correct wages, officials with the Attorney General’s Office announced Wednesday. TransCare, LLC, a medical transport company based in Berlin, is accused of misclassifying drivers as independent contractors instead of employees, officials said. An investigation began after authorities received complaints from drivers claiming TransCare had not paid them their full wages, authorities said.

The investigation by the New Jersey Department of Labor found that those drivers, as well as others, were employees of the company and did not operate independent businesses, authorities said. TransCare is accused of exercising considerable control over drivers, including directing where, when and how drivers were issued assignments and setting work hours and pay rates, officials said. Drivers were also required to undergo training, some of which was unpaid, and required drivers to use a third-party mobile application to receive instructions and assignments, officials said.



Drivers were required to pick up company vehicles in a parking lot where they left their personal vehicle, the same place officials said they were expected to drop off their time sheets and collect their paychecks. The civil suit also accuses the company of failing to pay minimum wage as well as overtime, failing to maintain records, pay employees in a timely fashion and make required contributions to various state funds, including the Unemployment Compensation Fund, officials said. The Attorney General’s Office asked the court for an order to end the misclassification of workers by TransCare and declare the drivers were and are employees of the company, authorities said.
