Trigger warning: sexual assault Nick Carter has been accused by a fourth woman of sexual assault, who alleges that she contracted sexually transmitted diseases (STDs) that led to cervical cancer. In a lawsuit obtained by People Magazine, Laura Penly said Nick sexually assaulted her in 2004, when she was 19 years old. According to Laura, they were in a “sexually intimate relationship and [they] would see each other approximately every few weeks.
” Their meetups would happen from December 2004 to February 2005 when she would visit Los Angeles and Nick’s Hollywood apartment. Laura said their sex was consensual at least three times. However, things changed when Nick “refused” to wear a condom even after being told by Laura, which led her to think “he was ‘clean’ of sexually transmittable diseases.
" She added in the lawsuit that she had never had unprotected sex before. In early 2005, Laura visited Nick’s apartment again thinking that they would watch movies together but the lawsuit alleges the Backstreet Boy, “told her no because the only reason she was there was to have sex.” In the lawsuit, Laura alleged that the sexual assault happened on Nick’s bed.
Laura said she was forced despite her “saying ‘no’ multiple times.” Nick allegedly did not use a condom again. Laura also alleged that she was told to keep the assault a secret since she would not be believed.
Months later, Nick apologized, they met up again, and a second rape happened. Laura alleges that Nick “infected plaintiff with various sexually transmitted diseases, including the human papillomavirus (commonly known as HPV), a sexually transmitted infection known to cause health problems such as cervical cancer.” She also tested positive for chlamydia and gonorrhea, plus cancerous cells, following a doctor’s visit in approximately July 2005.
In August, Laura “was diagnosed with Stage 2 cervical cancer and had to undergo numerous treatments.” This caused her “severe emotional distress, physical anguish, medical issues, intimacy issues, and other complex trauma.” She also said she was harassed by Nick’s fans when she testified against him.
She is “seeking damages in excess of $15,000 and is demanding a jury trial,” People said. Gianna N. Elliot, an attorney from Marsh Law Firm who is representing Penly, said in a statement to People , “It takes profound courage and resilience for survivors of sexual assault to publicly come forward in pursuit of justice, particularly in the music industry that has long fostered a pervasive environment of sexual exploitation.
” She added, "Carter used his power, status, and fame to sexually abuse and assault multiple young women and avoid any accountability. This lawsuit aims to change that pattern." The lawyer added that they hope Laura receives the justice she deserves, “and that this lawsuit serves as a catalyst, empowering other survivors to raise their voices and hold their abusers to account.
” Nick has denied Laura’s accusations, his attorneys, Liane K. Wakayama and Dale Hayes, Jr. said in a statement to People.
The two had never met, the Nick's lawyers added and called the accusations "nonsense." “Nick does not recall ever even meeting Laura Penly. He certainly never had any romantic or sexual relationship with her.
Ever," they said. “This is just more of the same nonsense from the gang of conspirators and their lawyers who continue to abuse the justice system to try to ruin Nick Carter,” the attorneys added. “It’s drawn from the same predictable playbook—lie in wait for decades until Mr.
Carter is celebrating a professional milestone, then hide behind litigation privilege to make utterly false claims in an attempt to inflict maximum damage on Nick and his family,” they added. The lawyers also plan to fight the allegations. Laura is the fourth woman to come forward with sexual assault allegations against Nick Carter after Melissa Schuman, Ashley Repp, and Shannon Ruth .
Nick has denied all these allegations, countersuing Schuman and Ruth for defamation in 2023, while a judge ruled in 2024 that he could not sue Repp for defamation. Schuman’s case will start in December, whereas Repp and Ruth’s will be in March 2026. Nick was in Manila in March for his Who I Am concert at the New Frontier Theater in Quezon City.
