A Muslim man has approached the Supreme Court, seeking a declaration that he should be governed by the Indian Succession Act instead of the Shariat law of inheritance.
According to Live Law, the plea has been filed by one Naushad KK, and was being heard by a bench of CJI Sanjiv Khanna and Justice Sanjay Kumar. The report quoted the court and claimed there was another similar matter, titled Sufiya PM vs Union of India, which was pending for hearing. However, in the other case, the petitioner – Safiya PM, had renounced her faith, while in the present one, the petitioner is a practicing Muslim.
Prashant Padmanabhan, who is the advocate-on-record in the Sufiya PM’s case, told the court that a Special Leave Petition, filed by the Quran Sunnath Society in 2016, where Section 58 of the Indian Succession Act 1925 is under challenge, is also pending. Section 58 of the Indian Succession Act excludes Muslims from its application. In the Sufiya PM matter, the Union Government had told the Court in October 2024 that it was for the Parliament to decide whether to extend the Indian Succession Act to Muslims, the report claimed.
