MHA okays Lalu's prosecution in land-for-jobs case

The Ministry of Home Affairs has granted permission to prosecute former railways minister Lalu Prasad in the land-for-jobs case. The CBI informed a local court and is awaiting sanctions for nearly 30 co-accused. The court has urged the agency to expedite the process for obtaining these sanctions.

The Ministry of Home Affairs ( MHA ) has accorded the much-awaited sanction to prosecute former railways minister Lalu Prasad in land-for-jobs case. CBI informed this to a local court on Friday. The agency's counsel also apprised the court that there are nearly 30 co-accused for whom prosecution sanction is awaited from the relevant authorities.

CBI has sought a fortnight to obtain sanctions against other accused. The court has directed the agency to expedite the process to obtain sanctions for the co-accused. At the last hearing, CBI had told the court that its request seeking sanction to prosecute Prasad and 31 other public servants is "under consideration" of competent authorities.



Irked by the delay in sanctions, a local court in July had directed authorities to take a decision by August 20. The court had made it clear that in the absence of any final decision an authorised official from the office of the competent authority shall appear in person to explain the delay. As regards other public servants, the sanctioning authority is the Ministry of Railways.

Gupta, Professor: Department of Finance and Business Economics, University of Delhi View Program CBI had previously received sanction to prosecute Prasad for his alleged involvement in the alleged scam. CBI had previously filed two charge sheets elaborating his alleged role in illegal recruitment of employees in two railway zones - central and western. However, CBI filed its final and composite charge sheet in the case, including all the remaining railway zones.

Prasad and other public servants were also charged in the final charge sheet by CBI. It is for this final charge sheet that CBI had sought sanction from competent authorities in June. In June, CBI had filed its final charge sheet against Prasad, wife Rabri Devi, son Tejashwi Yadav, daughter Hema Yadav, the then OSD Bhola Yadav and others.

A total of 78 people, including candidates (beneficiaries of the scandal), were charge sheeted by CBI. Alleging that Prasad, Rabri Devi and Tejashwi Yadav were "ultimate beneficiaries", CBI, in one of its previous charge sheets, had claimed that the "larger conspiracy is not restricted to lands alone being transferred in lieu of jobs. The modus operandi also shows payments being made in cash or for political and such other incentives".

The charge sheet said Prasad as railway minister "not only influenced the officials of West Central Railways but also exerted official pressure on them". (You can now subscribe to our Economic Times WhatsApp channel ).
