Law firm's new service to help 'more and more' unmarried couples resolve disputes

A law firm says it is launching a new service aimed at helping “more and more” unmarried couples whose relationships are breaking down.

A law firm says it is launching a new service aimed at helping “more and more” unmarried couples whose relationships are breaking down. The TOLATA Disputes Service, named after the Trusts of Land and Appointment of Trustees Act 1996 is being launched by Little Lever and Bury based firm Clough & Willis. It aims to help unmarried partners help solve property disputes if their relationships come to an end and is being launched shortly after the firm appointed Gary Hall as a litigation solicitor.

Mr Hall said: “As a business, we are seeing more and more unmarried clients coming through the door whose relationships are breaking down but don’t have co-habitation agreements in place. “That can be incredibly stressful, so we want our TOLATA Disputes Service to be there to help and to ultimately deliver a mutually beneficial outcome for all those involved.” Litigation solicitor Gary Hall (Image: Conker PR) Mr Hall says that TOLATA claims can be made if a property is jointly owned or if it is held one person’s name.



If it is jointly owned, TOLATA can work out whether it should be sold if one party refuses to sell. It can also work out the respective beneficial shares which each co-owner is entitled to from the proceeds of the sale. Mr Hall was unveiled as Clough & Willis's new litigation solicitor in January this year replacing the recently retired Graham Henry, who had worked at the firm since 2013.

His appointment was one of several high profile new specialists to have joined the Little Lever and Bury based firm over recent months and years. His specialisms also include dispute resolution and litigation matters including, Trust of Land and Appointment of Trustees matters.

Mr Hall also specialises in residential landlord and tenant clams, Japanese knotweed claims, county court judgements, neighbour disputes and insurance claims..
