KOCHI: The Kerala High Court has ruled that it constitutes a betrayal of trust for a husband to pledge gold received as a wedding gift without his wife's consent. The court upheld the conviction of a Kasaragod native who had pledged 50 sovereigns of gold, which his wife had entrusted to him for safekeeping in a locker, at a bank for his own personal use. Badharuddin delivered the ruling, confirming the six-month prison sentence and a fine of ₹5 lakh imposed on the husband by a Kasaragod Magistrate Court. The judgment came in response to an appeal against the Magistrate Court's decision. The husband had deceived his wife by showing her fake documents, claiming the gold had been deposited in a locker, when in reality, he had pawned it at the bank.



The truth came to light when their relationship deteriorated and the wife demanded the return of the gold. Upon discovering that it had been pledged, she lodged a police complaint, leading to the husband's conviction for criminal breach of trust..
