A company director has been fined following a complaint over damp and mould. Jason Adams of Riverstone-Abbey Estate Agents Ltd was requested to provide details regarding the management of the property which was being investigated by Hastings Borough Council following the complaint. A section 16 notice under the Local Government Miscellaneous Provisions Act 1976, which requests information and is an offence to not comply with, was served by the council.
Despite a reminder letter from the local authority, Adams did not respond and he also failed to appear at court. Adams was found guilty of failing to respond to a request for information and fined £2,640, as well as being required to pay a £1,056 victim surcharge and costs to the council of £877.09.

“However, where this is not appropriate or engagement is not forthcoming, we will not hesitate to take proportionate enforcement action. “This protects occupiers but also helps to support a level playing field for those who do comply with their duties and responsibilities.".
