BJP MP Nishikant Dubey made a strong remark on SC's hearing of the Waqf Act, saying that if the judiciary is to make laws, then there is no need for the Parliament to exist. A letter has been written to the Attorney General seeking consent to initiate contempt proceedings against BJP MP Nishikant Dubey over his comments on the Supreme Court amid the Waqf Act hearing. Dubey on Saturday made a strong remark on the apex court’s hearing of the Waqf (Amendment) Act, saying that if the judiciary is to make laws, then there is no need for the Parliament to exist.

In a letter to Attorney General R Venkataramani, Advocate Anas Tanveer stated that the BJP MP’s public remark is “deeply derogatory and dangerously provocative." The apex court began hearing multiple petitions challenging the constitutional validity of the amended Waqf Act, passed by both houses of the Parliament, on Wednesday. The petitioners argued that the Act’s provisions, such as the inclusion of non-Muslims in Waqf Boards and the denotification of “waqf by user" properties, violate constitutional rights.

Taking to X, Dubey wrote: “If the Supreme Court makes the law then the Parliament House should be closed," indirectly referring to the apex court’s review of the Waqf Act. Earlier in the day, Dubey also posted his ANI video clip on X in which, while responding to a question on the Waqf law and the recent violence in West Bengal, he said: “Iss desh mein jitne grih yuddha ho rahe hain unke zimmedar kewal yahaan ke Chief Justice of India Sanjiv Khanna Sahab hain (CJI Sanjiv Khanna is responsible for all civil wars in this country).".
