2 grams of syabu allegedly committed four years ago. Judicial Commissioner Maslinda @ Linda Mohd Ainal acquitted and discharged Mohamad Nizarudin Jaimee without calling for his defence. In her reserved ruling, she found that the prosecution had failed to establish a prima facie case against Mohamad Nizarudin who was accused of committing the offence inside a car which was parked at a residential area here on December 29, 2020.
The prosecution had produced seven witnesses to testify against Mohamad Nizarudin who was represented by counsel Hairul Vaiyron Othman and Luke Ressa Balang. Meanwhile, a retired army personnel was jailed for eight years by a Sessions Court here for trying to rape his niece. Judge Amir Shah Amir Hassan imposed the sentence on the 58-year-old man after he pleaded guilty to a charge under Section 376 (3) of the Penal Code, read together with Section 511 of the same Code.
The victim was 12 years old when the incident took place near a road in Papar in August 2023. The court heard that the accused attempted to rape the victim but failed after his penis did not erect when he wanted to insert it to her vagina. The matter came to light after the victim confided it to her teacher who later informed her mother.
