The Friends of Mill Road Bridge 2 group is fundraising to support the legal action – with work to install the bus gate scheduled to start on November 11 . A Traffic Regulation Order (TRO) to introduce a modal filter on the bridge was approved at a Cambridgeshire County Council meeting in October.
It will see the bridge closed to all motor vehicles, except buses, pedestrians, cyclists, emergency services, and blue badge holders' registered vehicles. A previous group named Friends of Mill Road Bridge challenged a previous order on technical grounds. The county council ended its defence against the legal challenge and undertook another statutory consultation which ended in September.
A spokesperson for the Friends of Mill Road Bridge 2 group said the original group had 'reformed' and will pursue a second legal claim. They said: "There will be another hearing in the High Court at some point soon, to determine the legality or lack thereof of the Council's continued determined effort to close Mill Road Bridge against all the evidence and lack of supporting data, and manipulation of the process to speed-run this thing to completion. "If we succeed this time, it might kill the thing completely for many years.
" They said grounds for the legal claim included that the reasons for the TRO are "not supported by evidence" and that the council 'ignored' a petition during the consultation period. The group is raising money for the legal challenge – you can read more here . A Cambridgeshire County Council spokesperson said: "We have reviewed the pre-action letter, indicating a potential challenge to the Mill Road Bridge Traffic Regulation Order.
The special Highways and Transport committee made their decision on 4 October, we have followed the statutory process, and we will be proceeding with the work on Monday (11 November)." A spokesperson for Mill Road 4 People, a group which supported the reintroduction of the bus gate, said they were 'disappointed' by the legal challenge. They said: "Sadly, local council tax payers will now be faced with yet more costs to defend a decision that has been shown in not one but three consultations to be the wish of local people.
"We call upon the County Council to continue with its published schedule of works to install the bus gate." They said that scheduled safety work near the bridge, including the installation of a traffic island and pavement-widening, is not part of the bus gate TRO and cannot be stopped by any legal challenge.
