The state unit of the BJP had moved the Calcutta High Court after it was denied the police permission to stage protest demonstrations at Shyambazar five-point crossing which is quite close to the hospital.

The permission was granted by a single-judge bench of Justice Rajarshi Bhardwaj to stage the demonstration for five days, beginning from Wednesday, August 20 and the time limit for the demonstration has been fixed from 12 noon to 9 p.m. The state unit of the BJP had scheduled a protest demonstration at the Shyambazar five-point crossing on August 16 and had erected a temporary dais for the event.

On the morning of the protest, Kolkata Police dismantled the dais, prompting BJP workers to attempt to construct another one at the same location. This led to a confrontation when the police intervened to halt their efforts. Shortly thereafter, the Kolkata Police implemented Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023 in the vicinity of R.

G. Kar Hospital. This enforcement, starting from August 18 and lasting for seven days, prohibits any form of assembly, protest, or rally within that area during this time.

Following this, the BJP approached Justice Bhardwaj’s bench seeking permission which was granted. The state BJP leaders have welcomed the Calcutta High Court’s order, stating that in West Bengal, it has become routine for opposition parties to seek the court’s permission to hold peaceful political events. The body of a female doctor was found in suspicious circumstances in the seminar hall of the R.

G. Kar Medical College and Hospital on August 9. So far, only one person has been arrested in connection with the case.
