Biochar takes one more stab at building in Moreau

Saratoga Biochar Solutions is requesting an adjudicatory hearing with the New York Department of Environmental Conservation to appeal the DEC’s denial of a pair of permits the company needs to build a facility in the Moreau Industrial Park.

“We have an obligation to our investors to protect the company’s rights and substantial investments in Moreau,” Saratoga Biochar Solutions CEO, Ray Apy said in a statement to The Post-Star. However, Apy said he and his company would rather move on with the project instead of litigating past decisions. “Saratoga Biochar would much rather work in collaboration with New York state to find a path forward, perhaps somewhere else and at a much smaller research and development scale that can easily address what the DEC noted in its denial of the Moreau permits as permit application deficiencies,” he said.

The DEC denied the Solid Waste Management Facility Permit Application and the Air State Facility Permit Application for the proposed biochar facility on Nov. 12, and the request for a hearing was made on Dec. 4.



The DEC denied the original permit applications citing insufficient information about the project’s effectiveness in meeting New York’s stringent environmental standards of the technology proposed for an industrial biosolids pyrolysis facility. The DEC has not yet issued a statement on whether it will approve Saratoga Biochar’s request..
