Times News Network Ludhiana: The district consumer disputes redressal commission has ordered Bombay Coins and Stamps , Mumbai, to pay Rs 5,000 to a city-based customer as composite cost and compensation for deficiency in service after it failed to deliver a silver numismatic coin to him. The commission also ordered the opposite party to refund the invoice amount minus taxes along with 8% interest from the date of invoice till the date of actual payment. Jeevandeep Singh of Chandigarh road, Ludhiana participated in the auction in 2020 and became the successful bidder for a silver numismatic coin priced Rs 54,000.
The opposite party issued a tax invoice dated Dec 27, 2020 for Rs 56,842 after adding GST of Rs 2,721 and shipping charges. The complainant made the payment through his bank account on Feb 2, 2021. However, he said that he did not receive the coin in the city or at the designated place in New Delhi.
He added that the opposite party made lame excuses and did not even generate an e-bill or get the postal article insured, which amounted to deficiency in service. The complainant said that he was entitled to a refund of the amount along with compensation as he had not received the coin. On repeated requests, the opposite party said that a complaint would be lodged with postal authorities but provided no details of such a complaint.
The complainant sent a legal notice to the opposite party on April 3, 2021 but no action was taken. Thereafter, the complainant approached the forum and sought Rs 56,842 for the coin along with compensation of Rs 50,000 and litigation expenses of Rs 21,000. The opposite party cited lack of territorial jurisdiction, suppression of material facts by the complainant and maintainability of the complaint.
The commission observed that the coin purchased by the complainant for Rs 54,000 was never delivered to the complainant in Ludhiana or to his representative in New Delhi despite charging of Rs 120 for shipping. It observed that therefore, the opposite party had rendered deficient services to the complainant.
